TCG Rewards+ Membership Terms & Conditions

These Membership Terms & Conditions (“Terms”) govern your access to and use of the TCG Rewards+ subscription service, website, and any associated products, promotions, giveaways, and member benefits offered by TCG Rewards+ (“TCG Rewards+”, “we”, “our”, or “us”).

By purchasing a subscription, creating an account, or participating in any TCG Rewards+ membership benefits, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Giveaway Terms (where applicable), and any additional policies published on our website.

If you do not agree with these Terms, you must not purchase or continue a TCG Rewards+ membership.

TCG Rewards+ is a monthly subscription service designed for trading card game collectors and enthusiasts.

Depending on your chosen membership, subscribers may receive one or more of the following:

• Pokémon Trading Card Game booster packs; • Pokémon Trading Card Game products; • Pokémon-related merchandise; • Promotional products; • International or foreign-language products; • Premium or limited-edition items; • Member-only discounts; • Access to exclusive promotions and giveaways; and • Other benefits announced by TCG Rewards+ from time to time.

Unless expressly stated otherwise, all products supplied through TCG Rewards+ are selected at random and may vary between members and between subscription periods.

To become a TCG Rewards+ member you must:

• be at least 18 years of age, or have the permission of a parent or legal guardian; • provide accurate and complete account information; • maintain a valid payment method; • comply with these Terms at all times; and • reside in a location that we are able to service.

We reserve the right to refuse, suspend, or terminate any membership where we reasonably believe false information has been provided or these Terms have been breached.

For the purposes of these Terms:

Account means your registered TCG Rewards+ member account.

Billing Cycle means the recurring monthly period in which subscription payments are processed.

Giveaway means any promotion, competition, trade promotion or member-exclusive prize draw conducted by TCG Rewards+.

Member means any person holding an active TCG Rewards+ subscription.

Membership means an active subscription to any TCG Rewards+ membership plan.

Products include booster packs, elite trainer boxes, collection boxes, promotional items, graded cards, accessories, merchandise, and any other products supplied by TCG Rewards+.

Subscription means the recurring monthly membership purchased by the Member.

Website means the official TCG Rewards+ website and any associated online platforms operated by us.

TCG Rewards+ may offer one or more subscription plans.

Each membership level may include different benefits, products, pricing, discounts, giveaway entries, or other member rewards.

Current membership pricing and inclusions are published on our website and may be updated from time to time.

We reserve the right to introduce new membership plans, remove existing plans, or change membership benefits at our discretion, provided any required notice is given where applicable.

Your TCG Rewards+ membership begins once your initial payment has been successfully processed.

Membership continues on a recurring monthly basis until cancelled in accordance with these Terms.

By subscribing, you authorise TCG Rewards+ to automatically charge your nominated payment method on each billing date for the applicable subscription fee.

Membership benefits are only available while your subscription remains active and payments are up to date.

Membership benefits may include one or more of the following:

• Monthly Pokémon Trading Card Game booster packs; • Mystery Pokémon products; • International Pokémon products; • Premium Pokémon products; • Promotional items; • Member-exclusive discounts; • Access to exclusive giveaways; • Priority access to limited products; • Early access to promotions; and • Additional benefits announced by TCG Rewards+.

Membership benefits may change from time to time as products become available or unavailable.

We may replace products or benefits with alternatives of equal or greater value where reasonably necessary.

TCG Rewards+ is a mystery subscription service.

Unless specifically advertised otherwise:

• products are randomly selected; • members are not guaranteed specific booster packs, sets, cards, languages, rarities, or products; • promotional images are examples only; • product availability may vary each month; and • duplicate products may occasionally occur.

Opening a booster pack or mystery product is a game of chance and TCG Rewards+ makes no guarantee regarding the contents or value of any sealed product.

Members acknowledge that the excitement of receiving randomly selected products forms part of the subscription experience.

From time to time certain Pokémon products may become unavailable due to manufacturer shortages, distributor allocations, import delays, discontinued products, or other circumstances outside our control.

Where this occurs, TCG Rewards+ may substitute the unavailable product with another product that we reasonably believe provides equal or greater value.

Substitutions do not entitle members to a refund provided the replacement product is of comparable or greater value.

Nothing in this clause limits any rights available under Australian Consumer Law.

The price of each TCG Rewards+ Membership is displayed on our Website at the time you subscribe.

All prices are listed in Australian Dollars (AUD) and include GST where applicable.

Subscription fees are payable in advance and are automatically charged to your nominated payment method on each billing date.

We reserve the right to change subscription pricing at any time. Where the price of an existing membership is increased, we will provide reasonable notice before the new price takes effect. If you do not agree to the price change, you may cancel your Membership before your next billing date.

Unless cancelled in accordance with these Terms, your Membership will automatically renew at the end of each Billing Cycle.

By subscribing, you authorise TCG Rewards+ to continue charging your nominated payment method until your Membership is cancelled.

It is your responsibility to ensure your payment information remains accurate and up to date.

If a scheduled payment cannot be processed, we may make additional attempts to collect payment over the following days.

During this period your Membership benefits may be temporarily suspended.

If payment remains unsuccessful after multiple attempts, we may:

• suspend your Membership; • cancel your Membership; • remove access to member-only benefits; • cancel pending giveaway entries where permitted by law; and • refuse future Membership applications where repeated payment failures occur.

Outstanding subscription fees remain payable until your Membership is cancelled.

Members may upgrade or downgrade their Membership through their online account, where available.

Unless otherwise stated, changes take effect from the next Billing Cycle.

No partial refunds or credits will be provided where a Membership is downgraded after payment has been processed.

Where a Membership is upgraded during a Billing Cycle, additional charges may apply depending on the upgrade selected.

You may cancel your Membership at any time through your online account or by contacting TCG Rewards+ Customer Support.

Cancellation prevents future subscription renewals.

Unless otherwise required by Australian Consumer Law:

• subscription fees already paid are non-refundable; • cancelling does not entitle you to a partial monthly refund; • Membership benefits remain available until the end of the current paid Billing Cycle unless your account has been suspended or terminated under these Terms.

After cancellation, your account may remain active for record-keeping purposes.

Where required by law, Members will receive any applicable cooling-off rights.

Unless Australian Consumer Law requires otherwise, no cooling-off period applies once products have been dispatched or Membership benefits have been substantially provided.

TCG Rewards+ ships products to eligible delivery addresses within Australia only and that we choose to service.

Shipping costs, where applicable, will be displayed during checkout.

Estimated delivery timeframes are provided as a guide only and are not guaranteed.

Delivery delays caused by Australia Post, courier providers, customs authorities, weather events, industrial action or other events outside our control do not entitle Members to compensation.

Risk in physical products passes to you upon delivery.

Ownership of products transfers once tracked item has been received.

Members are responsible for ensuring all shipping information is accurate.

If an incorrect address is supplied:

• TCG Rewards+ is not responsible for deliveries made to that address; • replacement products may be supplied at our discretion; • additional shipping charges may apply.

Address changes should be completed before your monthly order is processed.

If your order arrives damaged, you must notify us within seven (7) days of delivery.

We may request:

• photographs of damaged products; • photographs of packaging; • courier information; and • any other information reasonably required.

Where a parcel is confirmed by the courier as lost before delivery, we may investigate and, where appropriate, provide a replacement or other suitable remedy.

TCG Rewards+ is not responsible for parcels that have been successfully delivered to the address provided but are subsequently lost, stolen or damaged after delivery.

Nothing in this clause limits your rights under Australian Consumer Law.

Due to the collectible and sealed nature of Trading Card Game products, we generally do not accept returns for:

• change of mind; • unwanted products; • duplicate products; • dissatisfaction with random pack contents; or • dissatisfaction with the value of cards received.

Refunds or replacements may be provided where required under Australian Consumer Law.

Nothing in these Terms excludes or limits any consumer guarantees that cannot legally be excluded.

TCG Rewards+ takes reasonable care when packaging products.

Minor imperfections to external packaging, including shrink wrap, corners, seals or manufacturer packaging, may occur during manufacturing, transport or distribution and do not necessarily constitute a defective product.

Unless the product itself is materially damaged or fails to meet Australian Consumer Law guarantees, cosmetic packaging imperfections alone are not grounds for replacement or refund.

TCG Rewards+ is an independent retailer and subscription service.

We are not affiliated with, sponsored by, endorsed by, or associated with Nintendo, Game Freak, Creatures Inc., The Pokémon Company, or The Pokémon Company International unless expressly stated.

Pokémon names, artwork, logos and trademarks remain the property of their respective owners.

From time to time, TCG Rewards+ may conduct member-exclusive giveaways, promotions or prize draws.

Participation in any Giveaway is subject to:

• these Membership Terms; • the specific Giveaway Terms published for that promotion; and • any applicable Australian laws and regulations.

Each Giveaway will specify:

• eligibility requirements; • entry methods; • opening and closing dates; • prize descriptions; • winner selection procedures; • prize collection requirements; and • any special conditions.

Unless otherwise specified, entrants must:

• hold an active Membership where required; • meet any advertised eligibility requirements; • comply with these Terms; and • satisfy any legal requirements applicable to the relevant Giveaway.

Employees, contractors, immediate family members and any persons directly involved in administering a Giveaway may be excluded where required.

Memberships may include Giveaway entries where advertised.

Entries may accumulate based upon Membership duration, Membership level or promotional offers.

TCG Rewards+ reserves the right to verify all entries before awarding any prize.

Fraudulent, duplicated, manipulated or otherwise invalid entries may be disqualified without notice.

Unless otherwise stated, winners will be selected in accordance with the Giveaway Terms applicable to that promotion.

TCG Rewards+ may:

• verify a winner’s identity; • verify Membership status; • verify eligibility; and • request reasonable identification before awarding a prize.

If a winner is found to be ineligible or fails verification requirements, another winner may be selected where permitted by law.

Prizes must be claimed within the timeframe specified in the relevant Giveaway Terms.

Where permitted by law, prizes not claimed within the required period may be forfeited and a redraw conducted.

Prizes are not redeemable for cash unless expressly stated.

Unless otherwise specified, prizes are non-transferable.

TCG Rewards+ accepts no responsibility for any tax consequences arising from receipt of a prize.

As a TCG Rewards+ Member, you agree to:

• provide accurate, complete and current information when creating and maintaining your account; • keep your login credentials secure and confidential; • notify us promptly if you believe your account has been accessed without your permission; • ensure your payment details remain valid and current; • use the Website and Membership only for lawful purposes; and • comply with these Terms and all applicable Australian laws.

You are responsible for all activity that occurs under your account unless we determine that your account has been compromised through no fault of your own.

You must not:

• provide false or misleading information; • create multiple accounts to obtain additional Membership benefits or Giveaway entries unless expressly permitted; • interfere with the operation or security of the Website; • attempt to manipulate Giveaway results or entry systems; • use automated software, bots or scripts to interact with our Website or promotions; • impersonate another person; • engage in fraudulent payment activity; • misuse discount codes or promotional offers; • resell Membership benefits unless expressly authorised by TCG Rewards+; or • engage in any conduct that may damage the reputation of TCG Rewards+ or its partners.

TCG Rewards+ reserves the right to investigate any activity that we reasonably suspect to be fraudulent, dishonest or in breach of these Terms.

Without limiting our rights, we may:

• suspend or terminate a Membership; • refuse or cancel orders; • invalidate Giveaway entries; • withhold prizes pending investigation; • require proof of identity or payment ownership; • report suspected unlawful activity to relevant authorities; and • pursue any legal remedies available to us.

Where an investigation determines that a Member has acted fraudulently, no refund will be payable except where required by law.

All content made available through TCG Rewards+, including but not limited to text, graphics, logos, branding, artwork, software, photographs, videos, promotional material and Website content, remains the property of TCG Rewards+ or its licensors.

Nothing in these Terms grants Members ownership of any intellectual property rights.

Members may not copy, reproduce, modify, distribute, publish or commercially exploit any TCG Rewards+ content without our prior written consent.

We collect, use and store personal information in accordance with our Privacy Policy.

By becoming a Member, you consent to the collection and use of your personal information for purposes including:

• administering your Membership; • processing payments; • shipping products; • administering Giveaways; • communicating with you; • improving our services; and • complying with legal obligations.

Members may opt out of marketing communications at any time by following the unsubscribe instructions included in those communications.

By creating a TCG Rewards+ account, you acknowledge that we may send you service-related communications regarding your Membership.

Where you have consented, we may also send promotional emails, SMS messages or other marketing communications.

You may unsubscribe from marketing communications at any time; however, you will continue to receive essential communications relating to your Membership, orders or legal obligations.

TCG Rewards+ may suspend or terminate your Membership immediately where we reasonably believe that you have:

• breached these Terms; • engaged in fraudulent or unlawful conduct; • attempted to manipulate promotions or Giveaways; • repeatedly failed payment obligations; • provided false information; or • engaged in behaviour that threatens the integrity, security or reputation of TCG Rewards+.

Where reasonably practicable, we may notify you before suspension or termination.

Termination under this clause does not affect any rights or obligations that arose before termination.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where our goods or services fail to meet the consumer guarantees under Australian Consumer Law, you may be entitled to a repair, replacement, refund or other remedy as provided by law.

Any limitation of liability contained in these Terms applies only to the maximum extent permitted by law.

To the fullest extent permitted by law, TCG Rewards+ is not liable for any indirect, incidental, special or consequential loss, including loss of profits, business interruption, loss of opportunity or loss of data arising from or connected with:

• use of our Website; • Membership services; • delayed deliveries; • third-party courier services; • manufacturer delays; • product availability; • promotional activities; • Giveaways; or • events beyond our reasonable control.

Where liability cannot be excluded, our liability will be limited to the remedies available under Australian Consumer Law.

TCG Rewards+ is not responsible for delays or failures in performing our obligations where such delays or failures result from events beyond our reasonable control.

These events include, but are not limited to:

• natural disasters; • floods; • fires; • pandemics; • government action; • industrial disputes; • cyber-attacks; • supplier shortages; • transportation disruptions; • customs delays; and • failures of third-party service providers.

We will take reasonable steps to minimise the impact of any such event where practicable.

We may introduce, modify or discontinue Membership plans, Membership benefits, products, pricing or promotions from time to time.

Where a change materially affects existing Members, we will provide reasonable notice where required by law.

Continued use of your Membership after a change takes effect constitutes acceptance of that change.

We may amend these Terms from time to time to reflect changes to our business, legal requirements or services.

Updated Terms will be published on our Website and will take effect from the date specified.

Members should review these Terms periodically.

If you do not agree with an amendment, you may cancel your Membership before the amended Terms take effect.

These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, Giveaway Terms and any other policies expressly incorporated by reference, constitute the entire agreement between you and TCG Rewards+ regarding your Membership.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Failure by TCG Rewards+ to enforce any provision of these Terms does not constitute a waiver of that provision.

These Terms are governed by the laws of the State or Territory in which TCG Rewards+ is registered, together with the laws of the Commonwealth of Australia.

Any dispute arising under these Terms shall be subject to the non-exclusive jurisdiction of the Australian courts.
